The first step in seeking a divorce is to file a "Petition for Dissolution of Marriage." This document will outline some basic information about your marriage and detail the grounds for the divorce. This petition is then served on the spouse who did not file. There are two kinds of divorce in Illinois: uncontested and contested. An uncontested divorce occurs when both spouses agree on all issues involved. In a contested divorce, the spouses are unable to agree on child custody, property division, and more. If children are involved in your divorce, the process will be more complex. A number of decisions will need to be made regarding the custody and financial support of the children. In the state of Illinois, there are two kinds of custody to be determined. Legal custody gives a parent the right to make decisions regarding the raising of the child, while physical custody refers to where the child actually lives. A judge will determine a custody arrangement and child support plan based on the best interests of the child or children involved.
